Between navigating challenges such as the ever-changing coronavirus pandemic, a competitive labor market and day-to-day operations, HR professionals appear to have a lot on their plate in 2022.

As HR teams are often required to prioritize activities such as assisting employees, meeting compliance requirements, and other pressing demands of the organization, it can be daunting to also proactively focus on other workplace initiatives and improvements. However, these activities don’t need to take place all at once, and HR professionals need to be able to take a step back to evaluate this year’s priorities.

This calendar serves as a jumping-off point for HR professionals and provides a topic or activity to consider visiting each month of 2022.

The Occupational Safety and Health Administration (OSHA) COVID-19 vaccination and testing emergency temporary standard (ETS) prescribes specific measures employers covered by this standard must implement. This specificity will make it easier for OSHA to determine whether an employer has intentionally disregarded its obligations or exhibited a plain indifference to employee safety or health. In such instances, OSHA can classify the citations as ‘‘willful,’’ allowing it to propose higher penalties with increased deterrent effects.

In addition, OSHA has adopted its ‘‘egregious violation’’ policy to impose sufficiently large penalties to act as deterrents against bad-actor employers that willfully disregard their obligation to protect their employees when certain aggravating circumstances are present. Examples of willful disregard include large number of injuries or illnesses, bad faith or an extensive history of noncompliance.

The egregious violation policy utilizes OSHA’s authority to issue a separate penalty for each instance of noncompliance with an OSHA standard. This approach could enable OSHA to penalize employers for each employee lacking the protections afforded to others or for every workstation lacking adequate protection controls.

The table on the left provides an overview of the penalties employers may be required to pay for ETS citations, subject to OSHA’s discretion.

Affected employers with at least 100 workers (firmwide or companywide) must comply with the Occupational Safety and Health Administration’s (OSHA) COVID-19 vaccination emergency temporary standard (ETS). This infographic outlines some of the most important obligations employers should be aware of

Per the rule, employers must do one of the following:

  1. Implement and enforce a mandatory COVID-19 vaccination policy OR
  2. Create a policy allowing covered employees to choose to get a vaccination or wear a mask in the workplace and undergo weekly COVID-19 testing.

Additionally:

  • Employers must ensure employees who are not fully vaccinated are tested weekly or within seven days before returning to work.
  • Employers must determine the vaccination status of each employee, obtain acceptable proof of vaccination and keep a roster of each employee’s vaccination status.
  • Employers must report work-related COVID-19 fatalities to OSHA within eight hours of learning about them; work-related COVID-19 inpatient hospitalizations must be reported within 24 hours of the employer’s learning of the hospitalization.
  • Employers must require employees to promptly provide notice when they are diagnosed with COVID-19 or receive a positive COVID-19 test, and they must immediately remove any employee from the workplace if they are diagnosed with COVID-19 or receive a positive COVID-19 test.
  • Employers also must make certain records available to an employee or their representative for examination and copying.
  • Affected employers will be required to comply with most provisions of the ETS by Dec. 6, 2021, and with its testing requirements by Jan. 4, 2022.
  • Employers must provide employees reasonable time (including up to four hours of paid time) to get vaccinated and, if necessary, reasonable time and paid sick leave to recover from any vaccination side effects.
  • Employers must provide employees with information about the requirements of the ETS and workplace policies and procedures to establish it, as well as information about the vaccines, protections against retaliation and discrimination, and laws regarding criminal penalties for knowingly supplying false statements or documentation.
